AGREEMENT TO OUR LEGAL TERMS

We are Strengthmaker UG (haftungsbeschränkt) (“Company,” “we,” “us,” “our”), registered in Germany at Grundstr. 73, Dresden, Saxony 01326, VAT number DE363454667. We operate the Strengthmaker mobile application (“App”) and related services (“Services”).

These Legal Terms constitute a binding agreement between you (“you”) and Strengthmaker UG. If you disagree with any of these Legal Terms, discontinue using the Services immediately. We will notify you of any changes to these Terms. Users must be at least 18 years old.

1. OUR SERVICES

The Services are not intended for distribution in jurisdictions where such use would be illegal. Compliance with local laws is your responsibility. The Services do not comply with specific regulations such as HIPAA, FISMA, or GLBA.

2. INTELLECTUAL PROPERTY RIGHTS

Our intellectual property: We own or license all intellectual property rights in our Services. Content is provided “AS IS” for personal, non-commercial use. Unauthorized reproduction, distribution, or use of our content is prohibited.

Your submissions and contributions: By sending us submissions, you transfer intellectual property rights to us. Contributions posted on the platform may be used by us without compensation to you.

3. USER REPRESENTATIONS

By using the Services, you confirm:

Your registration information is accurate and current.
You will maintain updated registration information.
You have legal capacity to agree to these Terms.
You are not a minor in your jurisdiction.
You will not use the Services for unauthorized purposes.
You will comply with applicable laws and regulations.

Inaccurate information may result in suspension or termination of your account.

4. USER REGISTRATION

5. PROHIBITED ACTIVITIES

6. USER GENERATED CONTRIBUTIONS

By posting contributions, you grant us a perpetual, transferable license to use your contributions for any purpose.

7. CONTRIBUTION LICENSE

By posting contributions, you grant us a non-exclusive, worldwide license to use, reproduce, and distribute your contributions. You retain ownership of your contributions but waive moral rights. We may edit or remove contributions at our discretion.

8. GUIDELINES FOR REVIEWS

Reviews must:

Reflect personal experience.
Avoid offensive language or discriminatory references.
Not include illegal activity or mislead.
Avoid conflicts of interest.

We may remove reviews at our discretion. By posting a review, you grant us a license to use and distribute your review content.

9. MOBILE APPLICATION LICENSE

Use License: You are granted a limited, non-exclusive license to use the App on your device. You may not modify, distribute, or create derivative works from the App. Usage must comply with applicable laws and these Terms.

Apple and Android Devices: The license is non-transferable and subject to App Distributor terms. App Distributors are not responsible for support services.

10. SOCIAL MEDIA

Linking your social media accounts to the Services allows us to access content provided through those accounts. You are responsible for compliance with third-party account terms. We do not review or monitor social media content.

11. THIRD-PARTY WEBSITES AND CONTENT

The Services may include links to third-party websites (“Third-Party Websites”) and content (“Third-Party Content”). We are not responsible for Third-Party Websites accessed through the Services or any Third-Party Content. Use of Third-Party Websites is at your own risk.

12. SERVICES MANAGEMENT

We reserve the right to monitor, modify, or disable contributions or the Services for any reason, at our sole discretion, without notice or liability.

13. PRIVACY POLICY

Your use of the Services is governed by our Privacy Policy. By using the Services, you agree to our Privacy Policy and the transfer of your data to Germany.

14. DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA) NOTICE AND POLICY

We respect intellectual property rights and comply with the DMCA. If you believe your copyright has been infringed, notify our Designated Copyright Agent at:

15. TERM AND TERMINATION

These Terms remain effective until terminated. We may suspend or terminate access to the Services at any time for any reason, including violation of these Terms. If terminated, you are prohibited from creating a new account under any name.

We may modify or discontinue the Services without notice. We are not liable for any interruptions or modifications.

17. GOVERNING LAW

These Terms are governed by German law. Disputes will be resolved under the jurisdiction of Dresden, Saxony, or the EU country in which you reside.

18. DISPUTE RESOLUTION

Disputes will be resolved through arbitration or via the European Commission’s online dispute resolution platform.

19. CORRECTIONS

We may correct errors or omissions in the Services at any time without notice.

20. DISCLAIMER

The Services are provided “AS IS” without warranties of any kind. We disclaim all liability for damages arising from your use of the Services.

21. LIMITATIONS OF LIABILITY

We are not liable for any direct, indirect, incidental, or consequential damages arising from the use of the Services.

You agree to indemnify us against any claims or damages arising from your use of the Services or violation of these Terms.

We manage user data according to our Privacy Policy. We are not liable for any data loss. You are responsible for maintaining backups.

24. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES
